Model release vs photo release

I've searched posts but couldn't find anything that answered all of my questions. Until about 15+ years ago, I used to do a lot of photography as a hobby. I felt like i was pretty good at it. But due to career commitments and also the industry's transition from film to digital, I fell out of the hobby. Now I'd like to get back into it and possibly as a side business in the stock photo arena. But I want to do more fashion and portrait types of photography. A young woman has agreed to model for me this coming weekend and I'd like to have her sign a model release form. She's willing to do so. However, she's modeling for free and I'd like to give her something in return maybe in the form of a photo release. What kind of release gives her rights to the photos as well? Should I do that?

In your model release, just state what you 'will' provide for her, after the shoot. Retouched images, proofs, etc. Do not give up any copyright, as you own the images. Meanwhile, google 'model release form' and you'll find a ton of examples.

Basically, you just want to protect yourself and the images you take of said model. Also state your intent with what you might consider doing with the images, i.e., stock, personal use, etc. thereby protecting yourself from any liability later on. If you intend to sell the images, as stock, then, perhaps compensation can be noted on the release, etc.

Presumably, the model would, in the future, like to use the photo to promote herself as a model (of whatever type she decides to pursue) you might, for example, grant to her

  • right to use the photo to promote herself as a model
  • right to print copies of the photo to hand out, to promote herself as a model


but perhaps not

  • right to use the photo to promote a commercial product for pay


...in order to protect your own rights to derive income by using the photo(s) to promote some commercial product for pay.


Figure out what she can and cannot do with your photo without additional permissions from you.
