In the absence of a law-abiding citizenry, I foresee such actions as mostly causing headaches for the police, who I guess would be responsible for 'checking people's papers'. Based on what you've written, though, it's not that they're "deciding" anything, but they seem to have a specific methodology in place to determine whether someone has or not any kind of immunity... whether it's a good methodology is still very much up in the air.
