I see a couple of issues.
1. Did the photographer obtain a model release from the ballerinas? If not I think the photographer is open for lawsuit by them.
2. If the photographer did obtain a model release and posted them on sites like Usplash, she should have read the fine print and fully understood what could happen, how her images could be used.
3. The article indicates the photographer is trying to remedy the situation. But I think she's trying to CYOA, as the damage to the ballerina may already be done.

The photographer may have some recourse if she registered the photo with the US Copyright Office, before she published (uploaded) it. She can then pursue action against the person(s) using that image. IF not, well I wouldn't want to be her if that ballerina seeks remedy.
