A company wants to use my image..

I have an outdoor apparel company that wants to design a product, shirts I believe, featuring some of my images.. I have never went down this road before with a deal like this…I don’t even know where to begin to price this out, or sell the rights to them, what to charge… has anyone done this before? What would you charge?

"It depends..."

  • upon the type of usage (brochure vs. ads vs. internet usage)
  • the volume of use (how many brochures, how many ads it appears in, etc.)
  • how big the photo appears on the printed page
  • circulation size of ad
  • reusage of ad
  • in what market it is used in (a local market vs. statewide vs. national),
  • is company in budget apparel vs luxury apparel
  • local market...CA is very different from AR

no set answer.

Elements of pricing

  • value to the client
  • cost to you


You don't want to price higher than the client budget or their assessment of the 'value' in using your photo. That is very subjective, on the nature of the client and size of market served by them and what their budget can afford.

They want to use your images on garments? If so, how many, for how long and what size company are they? The value increases with a larger company, think of it as pricing the same project for a single owned restaurant compared to CocaCola.

1. Have you registered the image with the USCO, if not, get that done before negotiating any prices, you can do it yourself and for a small amount of money.

2. What type of company is it and how are they going to use your image?

3. It is for their exclusive use or not, unlimited or limited use or will you get royalties based on the sale of the item, royalties can be a real pain as you are relying on them to be honest about sales numbers, but some companies insist doing business they way?

4. Who at the company are you dealing with, is that person authorized to make a deal or just trying to help someone at the company? You want to deal with the person who is authorized to sign an agreement and issue a payment, less middle men less confusion and faster payment.

Any other questions just ask.

Thanks for the input guys…. They are a very small company that makes tshirts called Burlyfits.com. they found my work on IG and asked what I would charge for images that they want to use for a new project. I messaged back asking what kind of project and product. How it would be used or sold.. and I haven’t gotten an answer back yet…

That got me thinking , and led to my questions. Still a lot of unknowns, I just didn’t have a clue to where to even start thinking lol

I had that a few times, if the company is local you be better off using them for advertisement of your company, but if they are out of town whatever you think is a fare price.

From OP's response in post 5, it sounds like company wants to use OP photo on a shirt..in which case, I rather doubt the company wants their products to be walking advertisements with the OP company name in the credits on every shirt sold or in stores!
Not the same as using OP photo in magazine ad or brochure or on a web page. Maybe a royalty, like $0.10 per shirt sold to retailers, or something comparable, might be suitable and acceptable to the company, as low dollar commitment up front with royalties based solely on unit volume sold. $0.10 per $20 retail shirt is hardly backbreaking to the company...$0.10 on $10 wholesale price to a retailer is small potatoes (1%), too, but that comment from someone not familiar with clothing cost structure.
