good point Dave.... in cases like this the accused appears to have no rights at all.

Scotland has a slightly different law system from england (and i assume most other countries)... we have a verdict of not proven.

you may be guilty as sin (and everybody knows it).... you may be innocent of all charges.... if they can't prove it with solid evidence. you're off the hook.
it's more like the accuser having to prove your guilt rather than you having to prove your innocence.
(England are looking into adopting this law)

I can hear the judge now "so Mrs X.... what were your reasons for accusing this man of basically being a pervert and taking photos of your kids"

Mrs X "Um he had a camera with a telephoto lens and it happened to point in our general direction for 3 milliseconds"

she'd get laughed out of court.

that question should have been asked straight away by the park rangers and they should have dismissed the complaint as the paranoid ramblings of a woman who has fallen for the scare mongering.... hook line and sinker.

what's next ........do they ban Canon from making telephoto lenses because of what you could possibly use it for?
I'd imagine that i could bludgeon somebody to death with my 100-400....(it's bloody heavy enough :))....... it doesn't make me a potential murderer because i own/use it.

Exactly my point. British common law indicates that you are innocent until proven guilty. Australia, being a member of the commonwealth, adopted British common law as the foundation of our civil laws, and indeed our criminal laws.

We've become such a paranoid society, quick to assume someones guilt without any proof or investigation, that it's particularly sad - at least in my eyes.

I read a very interesting article a few weeks ago titled "In defence of the Paedophile" - despite the actual document title, it's a fascinating read with excellent points and doesn't actually encroach upon what you're most probably thinking. If you want to have a read of it (I copied it from the website into a word document as it was such a good, lucid read), I'll be happy to email you - PM me and let me know.

I'm certainly NOT supporting or endorsing Paedophilia, don't get me wrong, I'm simply making a statement that as a society, we have certain so called social rules that are very questionable, and the means and logic (and biases) of supporting such social rules are highly questionable - at least from my logical eyes. When you read the article you'll understand why I've said what I've said ;)
