Two releases? People and Pets

Can someone tell me how to go about covering the release for individuals who want their pets photographed and then having them involved in the final images as well? Do you do two seperate releases - one property release for the animals and another one for the people?:confused:

Yes. Model release for the people, and separate release for the pet (much like a property release).

I don't know what the law is in Canada where you are Funpix, but here in the states, you don't need a release for animals. They don't get the same privacy protection that people get.

It all depends on what your intended use is for the photos. The way you worded your question makes is sound as if you are being hired by the pet owners to take photos of them with their pets. If this is the case then now would reasonably assume that you are giving the pet owners the photos of them with their pets as part of your agreement with them. If this is the case, then, of course, no release is required for anything whatsoever.

Are you trying to also license these images to a third party? Are you wanting to use these images to promote your brand by putting them on your website or in your portfolio?

Ha! That's kinda cool. I love old threads. I wish that no thread would ever die.

But no, I didn't realize the age of the thread. It's actually a bit disappointing that this thread didn't get a lot more input from other members, and updates from the OP. Maybe we can correct that by adding useful content. I'lll try to track down the OP to see if I can get them back on POTn to respond.

This is my opinion when it comes to these legal questions. Research these things either through your personal attorney or at least look for a specialized attorney on the web. One the best resources for this is Ed Greenberg of thecopyrightzone.com (external link). Ed Greenberg and Jack Reznicki have published a book, now in its second edition that will answer about any question regarding copyrights and releases.
IIRC, Ed's reply to a question of do you need a model or property release, is if in doubt or do not know, then yes you do. It's always better to get one and not need it, than later on need one and not be able to get one.
