Who's signature do use for the witness? If its only the model and you, can you be the witness?

The Witness block is optional.
Much as the release itself, it is only adding proof of intent. The witness block is available to add an additional person who was present as added proof of intent. One is not always available.

You can sign it if you want, but think about it for a second. You possess the release so your statement that you witnessed the signature is as good as signing the witness block as it will be your word that you signed it also.

As backup, I usually take a picture of the model holding the release as well as ID card (especially if shooting anything suggestive or nude). That is additional proof that the model signed the release and actually looked at it before hand. So I have my word and a picture and the release versus the model's word if something comes of it later. On those occasions where the model was paid I have either a reciept or cashed check as additional proof.

That is about all I (or anyone) can do short of having an attorney present with a notary handy to validate the agreement, which is not very practical usually.

So the witness block is optional, but handy if there is a third person around. BTW: an assistant should always take precidence over an escort as the witness.

Just what I do,

@ Longwatcher

You have answered my question and concerns in great detail. I now have a better grasp on how this should be done.
Thank you.
