Hey all.
I found a myspace user using an image of mine. I sent him a warning, and contacted myspace about the problem. Nothing has happened. He goes to my school and he's a sophmore, Im a senior (hehe). Im thinking about scaring him by getting a lawyer make up a paper and send it into the mail to scare him. Other than that I don't know what to do really. I find it sick that they can't ask. I don't know him personaly, but all the sophmores in my school are rude, teachers know, and I know it. I know your thinking Im making a big out of this, but this isn't the first time on myspace.

I know how frustrating that can be. I had the problem several time, particularly with MySpace users. Usually when I told them that there were using the picture without my permission, they'd remove it or provide proper credit. I had one case where the person did not remove the picture, despite repeated requests to do. I even informed his internet service provider and no action was taken. It seems to be the only recourse is a letter from a lawyer. I had thought about doing that myself, but it would just be so expensive.

It seems to be an epidemic really, that younger people think that anything on the internet is free for the taking and for use without any need to provide credit to the original source. Many don't even realize that it is wrong.

This is painfully true. Many people -- not just young people -- don't think but know that anything on the Internet or web is public domain. The difference is subtle but profound. I have personally run into several people who said "whaddya mean it's not public domain?" when I told them their site had other people's copyrighted work.

There is little one can do in reality. Just don't post stuff on the web that you want to sell.

I have a problem family nearby with dogs that run wild. They just got the choice of $101 fine or 5 days in jail so they paid up. The dogs have been kept in the garden with an invisible fence and since the judgement the dogs haven't been seen without their collars (so far). I do not believe this situation will continue and fully expect to have to take them back to court and to keep having to take them back to court. I would like a permanant solution but short of the dogs being run over when they're in the road or somebody taking a shotgun to them (which might be against the law in a residential area) this is my only recourse. Eventually it will get so expensive as the fine doubles each time that they'll get rid of the dogs or move away. In the meantime it's just going to be a pain in the backside.

Essentially you have the same situation with your photo. It's a pain in the backside that somebody's pinched it but there's not much you can do about it. If it's been hyperlinked from your original location then you could replace it with a photo of a pair of bare buttocks. That tends to work.

If you're a senior and he's a sophomore, do what I'd have done back then; beat the crap out of him.

Ok, just kidding. Contact your local Justice of the Peace and see if you can take him to small claims court. That's what the JoPs do here. I don't know if copyright infringement is under their jurisdiction for the matter at hand, but it won't hurt (or cost) to ask.

If you want to pursue it legally, you need to register the image with the copyright office. It will cost you $45. Without the image being registered, you still own the copyright, but the legal bite you have is like biting with only 2 teeth. If you register after you found the infringement, its like biting with 12 teeth. But if you registered the image before the infrinment occured, you are biting with a full set of teeth, and it's going to hurt the other party.

In this instance, probably the best thing to do is have a lawyer send him a cease and desist letter. That will probably do the trick. You need to determine if the $100 or so is worth it to you to have that done.

Gather up all the proof of copyright that you have and go to the school authorities. They do not have to play by the same rules of engagement as the other authorities. If you have a school police resource office see him also. Remember, the suspect is a thief and you need to keep hammering that issue.
If that doesn't work then get over it and go about your life. The thief may be a puts but it does not affect who YOU are. Go out and have fun.

My school doesn't have a school police office but they do have a duty cop their durring lunch. I might ask him. This is quite fun to me, till the money haha, but thats ok.
