There is a lot of talented processing brains here. Post some of your photos that you are unhappy with and I'm sure some of the people here can add their style to it and maybe you'll like the resulting photo better than what you got...

Probably better not do that - copyright issues, you know. We aren't allowed to touch images unless the copyright holder specifically gives permission (which is why we, as posters, have to select that it's ok for people to edit our images).

Can you say "copyright violation"?

Unless the OP has a written release giving her rights to do this with her images, then I'd suggest not doing it. Not only would she be liable, but the owners/managers of the board would be liable.

Usually, if you have a disc you paid good money for with your wedding photos you SHOULD have a release too. At least, this is what I do with my clients.

So post 'em up.

;) well thanks for the offer... however I haven't got a disk :>.. If I were to scan a few....The photographers name is not on them anyplace...and they used kodak professional..so their name is not on them..ORR my moms friend was at the wedding with her 20d and a few lens..she made me a nice album. I do have that on disk someplace..Maybe pick one or two out and post them.. and If the talent here has time they can *jazz* it up..

It doesn't matter if the photographer's name is on them or not, the copyright belongs by law to the person who took the photo. Scanning and posting them would be a violation of copyright law.

Ask your mom's friend if you can post up some of her photos and modify them. If she is cool with it then go for it. I probably wouldn't scan your photographers prints and post them up for modification without a release though. You can try to get one from him but if he didn't provide one then you'll likely have to pay for it.

And Karen, most of us here are QUITE aware of copyright issues... and it's easy to inform those who aren't, without barking policies in our faces.

Uh ... I don't know what your problem is, but I'm not "barking" anything. I merely stated that the photographers name does not have to be on the photos - that they are protected by copyright automatically. I don't know where you get "barking" from, from a simple statement of fact.

Every so ofetn one of these copyright issues comes up that begs for light. This seems one. If the OP posts an image "as is" and does not claim it as his/hers and credits it as due, for purposes of discussing the image itself and gaining some sort of knowledge about the image, especially since it's technical value may be in issue and the OP is seeking opinions in that regard...the use would likely be considered a "fair use" as determined by code and case law across the United States.

To suggest otherwise would be tantamount to saying that a bride or groom who had some photos could not show them to friends and family or, if unhappy with them, could not share them with their lawyer for opinion purposes.

As has been pointed out from time to time, copyright law protects the creators of intellectual property, but should not be considered an absolute and impervious barricade to an average day-to-day citizen enjoying and sharing such a work.

Just my .02 worth...

Subtle - sure, posting them to look at and critique is FINE under fair use. What is being suggested is that the OP should post the photos so that the members of this forum can edit them in photoshop and try to make them better for OP. That would be creating a derivitive work and is definitely a copyright violation.

The only way you can get around it legitimately is if you can contact your photographer, and ask for permission to edit the images. Likely his/her original copyright only applies to the original media, and as we know, no duplicates, or tweaks can be made. So the best thing you can do is just ask..

Also Pekka (the owner of the board), if any situation arose from some infringement, shouldn't be accountable. There's the terms of the forum, and I'm sure he couldn't get sued.

I'd probably just work with the images you already have access through, with the 20D photos, (with permission of course). :)

Doesn't copyright mean that the customer cannot reproduce the images for money... They can't modify their wedding images? That's a weird thought!

I shudder to think that they would modify them. If they hired me to photograph them, I'd like to think that they would have enough respect for my style and my vision not to do this.

What if someone took photos of your wedding and you really loved them but wanted to try some of your own ideas on them as well? My husband and I recently had our photos taken at sunset and the photog will include the originals as well for exactly this reason. He understands that I play around in photoshop alot and may have some different ideas.
