Hi all, I photographed a dog surfing competition (first annual) back in Aug 06 and have been recently contacted about using one of the photos for a CD Jacket. After reading through many of the threads here I am not sure if I can legally sell the photo. The event was open to the public, many folks where taking pictures. I didn't ask permission as I never thought anyone would be interested in purchasing them. If I do need a release what kind would it be a property release because of the animal is owned by a person? and I would assume that I should try to contact the organizers to see if they will release my rights? to sell the photograph.
The other issue is the company that wants to buy the photo is located in Japan and would like me to send a high res photo to the asap. I just don't feel comfortable doing that without a contract or agreement. Are there specific items I should be including in the agreement

Thanks and I look forward to your comments

Laws vary from country to country but in most Western countries I would think you could legally sell the pic. Generally you aren't violating any privacy laws if the event was conducted in a public place and there were no specific restrictions on commercial photography.

Of course the dog could sue for defamation should the image be used in a way that smears its reputation, but he/she would normally sue the publisher.

Bungee, The event was public and no signs or anything stating the photography wasn't allowed. So I should be good to go with selling the picture?
thanks and look forward to more replies
