Trouble Making my new action

Hey guys,

I'm making a new watermark action (have done it before) and its giving me a few troubles, or I've left something out.

When I play the finished action, it stops at when it is supposed to align the selection to the bottom and then the right. it says " could not complete the command because there are no layers to be moved". Now I understand why it would say it, but I can visibly see the layer and its selection.

So whats the deal? For the record, its generally followed off the russel brown tutorial. I had one before, but now need a new one, so i'm pretty sure I did the same as before, now its messin' up.

I've made several actions using the russell brown method as my starting point. They all work fine. If I remember correctly when you are doing this you have to an active selection (all if I recall). Would this happen to be your problem. Otherwise I would try building it again. I know I had to do that once when I that I had it nailed but missed a rather insignificant step but it crashed the action.
