Not true in all cases for #1. As with all grey areas the court can determine the status. It's best if there is a recognizable person (or sometimes object) in the photo to get a release.

You can certainly try it without a release, but you might find yourself in a mess.

Actually I always get a release, but then again I want to make sure I can use the images for commercial purposes if I so desire.
