It sounds kinda sketchy to me, is sure doesn't sound like the sealing in the 1d bodies (that is to be expected) That said, I think I would prefer to upgrade to a 1d body... but that 40d does have some nice things (including price) that makes it purty. Canon calls it "weather resistant" in their press release, not weather sealed. Still - it has MORE sealing than the 20D/30D and those have put up with some rain...
