can anyone ID this spider??

Okay, I am no nature expert, saw this spider tonight when I arrived home and was able to grap a decent picture of it before my sister obliterated it with a stick:| Also, C&C welcome.

This looks very similar,, slightly different head,, but same rear portion

this is a common orb web spider one of the most uploaded photos in this forum they come in many many different colors and patterns! they are very common in gardens and they dont bite!
