Question: I have a smug mug, and I recently got this email from a person I shot saying, I cant sell her pictures without her consent. Can she actually do anything? It was a public place @ the House of Blues. And now she wants copies of all her pictures.

Most states have a "Right of Publicity" which precludes you from doing anything, including displaying, images of people for whom you do not have a model release. Being in a public place allows you take their picture (there are even restrictions about this) but that is totally separate from displaying or selling their image or likeness. So it is reasonable that she can demand that you take down the pictures unless they are newsworthy and you are doing a news article. OTOH, she cannot demand anything ... if she wants the pictures she should pay for them. But in any case, why would want to display pictures of someone who asks that you don't? This is not an area in which your ego should play any part. Doing things "just because you can" is why we have all these crazy rules and laws in the first place ... people abuse privilege.

I took down her pcitures after she requested it. I just wanted to know for future reference, just in case something does actually happen. But thanks for the feedback!

Most venues have a "your image may be recorded for commerical purposes" policy. You would have been well within your rights to tell that catty b--ch to f--k off. However, sometimes it's best to just remove the image.

I've done this before to be nice, funny thing is I saw the person again and she asked for a photo and I was in a bad mood so I told her to f--k off.

I get really annoyed when people try and pull the legal **** on me.

I just turn around and say you gave away your right to the photos when you stood in the shot.

plus on gambitlive when you register the terms & conditions state that by registering you agree to let photographers publish your photo etc etc..

othertimes I just tell them to **** off..
depends on my mood, and the person having a go at me
