How do I batch for for one side defined/constrained?

Not sure if this is going to make sense but heres what I'm trying to do...

I want to batch a folder of images and have the height be 800pix - the length can fall where it may, but I want to keep the aspect of the original. So basically a vert image would be around 800x640 and a horizontal would be 800x1200.

I have been able to make an action that does this but it will only work on one or the other. I can't seem to figure out how to make it work with mixed V/H images.

Is there a way?

An action should work, but if it doesn't, try File-Scripts-Image Processor (that's what it's called in CS2, anyway.)

UnMix them.
Depends what software and workflow you are using.
E.g., when I used iView Media Pro & PSCS3 workflow, iView enables a user to automatically select browsed horizontal and vertical images with a single menu selection (by looking at their EXIF metadata tags).
Then I would temporarily put the Horz selections in one folder and verts in another.
In PSCS3, I had two Actions; one for converting any Vert image to an:
8-bit/800 x XXX protect Aspect/Convert sRGB/Bicubic Sharper/Save as... JPG/Compression X,
and another for Horz. The Action does not overwrite originals.
I would point these actions at the folders, and walk away.
Then I would put master images back in one folder.
You can do the same with Photo Mechanic or any good DAM program combined with PSCS.

With PS Lightroom it is even easier. First, because PSCS does not allow a Save as... JPG on 16-bit files, need to add the 8-bit step, while PS Lightroom permits this, and second, because Lightroom Export... permits defining an Preset to do this, which runs like an Action without Folder switching. In PS Lightroom, you select group by Vert or Horz metadata, even if they are RAW, and run the Export....>Preset Name X.
I do not know what Bicubic algorithm Lightroom uses, but the output is fine.

Done.
It's up to you and your workflow convenience.

One says I can, one says I can't though. I appreciate the detailed explanation Rabin and I will go that way if there is not a shortcut somewhere.

Maybe I have different photoshop CS3 then others, but I have always been trying to figure out how to make the long side 1024 pixels regardless of portrait or landscape orientation. It is easy making one direction (height or width) a set amount of pixels in batch.

To have a 800 pixel height, just set up an action to use Image - Image size, then check all the boxes at the bottom and then set one dimension to your 800 pixels (like Height in your case ) and there you have it. Just run the action from Bridge - Tools- Photoshop- batch - select your actions.

I frequently have to run batchs to resize so I know it works in PS CS3 for me.

It is important to make sure that auto-rotate was activated in the camera and the software though or otherwsie it thinks the height is the vertical in all cases.

First select the folder or images you want to edit. Then select the location you want them saved to. For example they will be saved in a folder called JPG (if you save as jpg format).

When you select the JPG format, firstly select the amount of compression. Depending on my use and file size I require I vary this.

Next (and importantly for you) is the point where you set the maximum size (in pixels) that the image can be.

If you need images that are 800 pixels high, set the height to 800 and leave the width blank.

This will set all your images to 800 pixels high and the width will be the default (whatever that may be). I usually set the maximum Width/Height to be the same size for consistency - the above will convert all my images to a maximum height of 700 pixels (for portrait images) and 700 pixels wide (for landscape style images)

Hope this has helped those using CS3 although this works in previous versions too..... Lightroom also has this capability.
