I'd have a word with Serena here too:

I mean, how *dare* she take photos of Folkestone, I'll bet she doesn't even live there.... worst of all she is trying to sell these.

Phone the Police!

Thanks for your constructive feedback Dark Night... thats a really positive way to use your 1st post of the forum!!

I really dont think you are getting the point of my post. its not about people taking photos of the area i live in, it was about a guy recreating my shots and me getting opinions on how others would feel of which all of the other members have given good and helpful feedback.

I hope that your future postings are a bit more constructive rather than sarcastic and immature.

I don't really see his shot as a copy of yours other than the angle which is repeated on bridge shots everywhere. He re-shot with more in the frame and I like his take on it. I like yours in a different way, it's more moody which is more my style. If he's copying all your best work that would get me a little p*ssed as well. He should find his own inspiration instead of using your eyes. Get a really good shot and then stake out the area with a shovel and a bag of lime. When he shows up to copy it, Bang, dig and apply lime liberally. Bob's your Uncle, problem solved. (humour, not actual advice. :))

Dark_Knight: If you find a post ridiculous you don't have to say anything but are free to do so. Problem is you set the bar right away for people critiquing your work. Constructive advice never comes back to bite you. You'll get the same in return.

To be realistic there isn't much you can do about it..It is quite legal to shoot exactly the same photograph as another photographer,,it doesn't contravene copyright..

You can only go on the issue of fair play or maybe do something different during post processing..

i do see bubbawillums point to a large extent. i agree that no one owns the view, but if someone saw the work you presented, then immediately followed that up with their own work in the same location, time and again, then i would get pretty annoyed. it isn't a copyright violation by any stretch, i don't think bubbawillums was meaning that.

it's not the location themselves, more that the other dude is copying the order of locations. if he just presents the same images a few days later then he is copying bubbawillum's inspiration time and again.

there isn't any legal infringement by a long shot. i would be 'weirded out' if i knew someone was waiting on my shots to copy their general location and composition. nothing you can do, maybe post some comments on his photos that bring people back to your shots, smart people, the ones that matter, will realise what is going on.

I think the shots are different enough in their own right, but I can see why you'd be annoyed - his version is pretty good too! I like the clouds in his more, but don't like that big ugly thing in the foreground.

I have to admit to being guilty of looking on Flickr for locations to take photos from, but once there I like to compose my own shots. Problem is they're bound to look similar at first glance (unless you process them completely differently), so I hope nobody thinks I'm copying them!

Thing is, if he can figure out where you took your photos then they must be pretty well-known spots. I can see it would be annoying he constantly did the same locations as you though - maybe you can add some light-hearted comments to his pics asking if he's stalking you? If he knows you're watching his pics then he might not be so blatant about it.

Hmmmm have a look at this page on flickr then...

http://www.flickr.com/groups/kent-uk/pool/page1 (external link)

People take pictures of the county of Kent, stick them in this pool and then later on other people also take pictures of the same thing...some of them with exactly the same angles as others in that pool... hang on a sec don't I recognise "Bubba" as one of those flickr users. I always thought that was the point of Flickr - to allow people to share inspiration and learn from what they see from others. I'd delete your account, maybe you can get your money back?

Being less sarcastic *just for a moment*, I cannot see how any claim of "stalking" can be serious here, but I could probably see legal action for rubbishing someone's character...

Personally, if I found someone else using my shots as inspiration, I'd be flattered. Unless they kept doing a better job than me in which case I'd be pissed

Its a major Annoyance at most, at the least its a form of flattery, this guy might just get sick of copying you and move on, or he might not but I can see he's got no love of the craft, I predict this is just a phase he's going through and it will pass... just ingnore the SOB and dont even go looking for him to see if he's still doing it, its obviously eating at you to the point you wanna tell him to back off (IMHO that would make YOU look like the moron) just ignore him and let it go till he dissapears. Your worry is wasted on this fool.

It looks like that guy spends a LOT of time at the beach, more so than yourself. He probably saw your pic, liked it and put his own little twist on it by adding the post in the foreground.

There's not much you can do about it. Think about how many people take the same shot of the Chicago skyline from the Adler Planetarium. There must be hundreds, if not thousands, of them out there in the ether.

Well isn't it interesting what a google search can show up? There I was searching for any usage on my pics and I find I'm being accused of copying somebody else's images.

My initial reaction was laughter, although since sitting back and reading the replies I feel I have been harshly portrayed here by some and the thread is deserving of a formal reply. I pondered contacting Dan direct but my integrity has been questioned on a public forum so I thought the response should be delivered here too.

Copying your pictures. LOL what are you suggesting? I'm carrying a bunch of prints around, lining up an exact shot then hitting the shutter button. Please. Do you really think I'm getting up at 5am for a sunrise session to do that? 2 days later I'm at the exact same spot - lol. Hmm your example was posted in 2005 and mine was taken in 2008. I think there's a slight exaggeration going on there. Were you on the sauce when you wrote this?! I did wonder if this was a case of, "somebody else on my patch, and I don't like it"?

Right, mini rant over. I can sort of understand where you are coming from here. I can see your later response and you take a lot of that back. Fair do's. A lot of the feedback you've had here has been fair and to the point, particularly from those that have taken the time to look through the rest of my pictures. There is a fairly large diversity to what I've done and to the location. I think though it's worth me giving you an idea of where I'm coming from here as it will respond to a few other posters and maybe make others think twice before jumping to the same conclusion.

I decided to try my hand properly at landscape photography only last November. Bought some filters etc, read just about every book/magazine I could, looked at lots of other people's pictures and researched locations. I always liked a good sunrise/sunset and I really wanted to get a half decent set of shots. Another forum I frequent has some real crackers from a few regulars, which was where most of my influences came from. So I spent a good time looking around the net for places near to visit. I live about 25 miles from the coast, so it's got to be worth going to if you're getting up early. I really wanted somewhere close with a rocky outcrop, and they're not that easy to find along that stretch of coast. Folkestone certainly fitted the bill. I’ve spent a few early mornings there and you've seen some of the results. In a few months I’ve learnt a great deal and fairly happy with some of the results. I do get a buzz from looking through a viewfinder and seeing something special. That’s something I never thought I’d say about landscapes.

Regarding the picture you posted, my personal opinion is that if you stuck a dozen competent photographers in that location there's a good chance all of them would come back with a similar shot. Foreground interest - check, Lead in lines - check, Rule of thirds - check. I was never happy with that shot of mine. It needed a higher angle as that thing in the foreground just gets in the way and disrupts it. I really don't think I've ever seen that shot of yours before I found it here. If I did, and subconsciously reproduced it, then you deserve credit for that. I think they are actually quite different, although obviously of the same thing.

You have mentioned you've sold a few shots locally. If that's what bothers you here, you've nothing to worry about. I'm only doing this for fun while the motor racing season is on a break. I've got a few photos on stock sites, and so far made about a fiver! I doubt that's affecting your sales or livelihood too much. As a goodwill gesture though, if you want me to take anything down, then let me know.

I hope that clears things up, and you're not too gutted you don't have a stalkr (sic). Thanks for some of the kind comments that people have said. I must be doing something right. I doubt this thread would exist if I wasn’t.
