You're on your own.
Take another look at the agreement.
Sorry. I hope you aren't already screwed.

Nope they wont really do anything about it. Even if they did, he/she could just come back under a new name. You really are on your own with market place sales. Id call AMEX now. No tracking number transactions over. Somethings not legit. How much was the item?

Yep, dont wait. There are time limits, although I am sure they are similar to visa where you have approx 120 days from the expected date of receipt. IMO, dont push it past 30 days.

If I remember correctly, Federal law gives you 60 days from the date of the statement containing the bogus charge to dispute the transaction. Your CC may give you more, but they can't give you less.

AMEX is pretty good about these things. I have nothing but good things to say about them.

Its not a bogus charge, this is what is refered to as a "merchant dispute". NOT FRAUD.

If I paid for merchandise and didn't get it within a reasonable time, i'd call it a bogus charge. It may or may not be fraud, but it's certaintly disputable.

I am just telling you how the banks see it.

In the banks eyes a bogus or illegitimate charge would be fraud, which means the transaction was made without your permission.

A merchant dispute is any dispute concerning the receipt of goods or services.

If the seller claimed it was sent 9 days ago and it hasn't showed up yet, then something's fishy. Still, I'd give it 2-3 weeks. You won't lose anything by waiting a bit longer. If nothing at the end of 3, I'd dispute it.

this is what he said and been 10+ days since

"It was dropped off at the UPS store today but I missed the last pickup for the night. She said she will have the tracking # in the morning and I will forward it over then."
