Going to be interesting to watch. Story says "Internet only" vendors, so I guess that lets B&H off the hook.

New York Orders Large Web Retailers To Charge Tax
Amazon Refuses, Says Now Is 'Wrong Time To Increase Taxes On New Yorkers'
NEW YORK (CBS) ― New York Internet shoppers, take note: in five weeks, sales tax-free shopping will end on many Web sites thanks to rewritten state rules that are trying to force Internet retailers to collect.

At Chrono Tech Watches in White Plains, Jerry Nally is glad the clock is ticking on many Internet retailers that don't charge New York sales tax. Nally says those so-called "e-tailers" steal his customers.

"They'll come in our store, look at our product, touch it, play with it, look at the warranties, then go back to the web and buy it tax free," says Nally.

For years, retailers with "brick and mortar" stores in New York, such as Wal-Mart, have charged sales tax on orders placed through their Web sites. Yet Amazon.com and other e-tailers with no physical stores have not charged the tax, much to the delight of Internet bargain hunters, like online shopper April Cantin.

"Coming here, you have to pay a lot of tax, when you pay on line, you pay nothing, just shipping and handling and the item," she says.

In the midst of a budget crisis, New York is now telling Amazon and certain other large Internet-only vendors they must collect state and local sales tax -- if they allow sales via "click-throughs" from New York-based Web sites. The new rule is set to go into effect on June 1.

The state estimates this new Internet tax will bring in $50 million this year and $75 million next year.

The New York Retail Federation hopes the new rule is the first step toward collecting sales taxes on all Internet commerce.

But the new rulings aren't sitting well with the Internet giants. Amazon, the largest Internet retailer, is objecting to the decision, saying "this is the wrong time to increase taxes on New Yorkers."

"You will drive people away. People are not going to want to shop on line anymore," says Cantin.

Nally is hoping online businesses will comply, however, telling CBS 2 "it's about time!"

"I have to pay tax, and Amazon should pay tax, it's as simple as that," he says. "There's no reason for a difference."

That's really bad.. If I had to pay taxes from buying off Amazon.. I'd rather buy it at my local store and save shipping and the wait time.

Well here in NY state we have had for a couple of years line 35 on IT150 tax form (our state tax form, also on IT201 line 59) it says:
Sales or use tax (See the instructions beginning on page 66. Do not leave line 35 blank.)

This is where we are supposed to claim items we bought outside of NY state and pay taxes on them :(

Ahh, my formatting got a screwed up.
I dont think they should tax the net purchases. it already entails heavy shipping costs.

Amazon has no warehouse here in New York so there should be no tax for New Yorkers. This is wrong.

ya... If amazon charges tax in CA it might be better to go to like BH or a company based in oregon!

I'd appreciate it if someone could tell me how it is legal for a state to tax a company outside of the state? Seems to be that according to the constitution, states can not impose taxes on other states. But I guess, that part of it is getting ignored too.

According to our tax forms you need to pay taxes on these items :(
A quote from the 2007 NY IT150 and 201 instructions-

Deliveries into New York State — You owe state and local
sales or use tax if you:
• purchase property or a service that is delivered to you in
New York State without payment of New York State and
local tax to the seller, such as through the Internet, by
catalog, from television shopping channels, or on an Indian
reservation.
Purchases outside New York State with subsequent use in
New York State — You may also owe state and local sales or
use tax if you are a resident of New York State at the time you
purchase any of the following outside New York State:
• property you bring into New York State for use in New York
State;
• a service performed on property outside New York State,
and you bring that property into New York State for use
here; or
• a service (such as an information service) you bring into
New York State for use here.

Yes. What we call "sales" tax is really purchase tax. The seller isn't being taxed, the purchaser is. The seller is merely collecting it for the state. That is NY's issue, I think. Tax filers are ignoring their responsibility to account for out-of-state online purchases and are trying to force the online retailers to collect the tax just as the in-state B&M retailers do.

If Amazon has no physical presence in NY, I wonder how they'd hope to enforce it. I agree with others that this smacks of a "Retail Federation" attempting to impose rules on interstate trade. But, the constitution is plainly ignored all the time in favor of newer "interpretations" that are supposedly more appropriate to modern times. I'm not surprised they're trying.
