Intellectual Property/Copyright Infringement?

Having been a victim of blatant image theft where my images were taken then used in a advertisement (that was then e-mailed to me by said company) my ears perk up when I hear mention of such cases happing to my friends/peers/fellow hobby photographers.

This was brought to my attention recently:

If you read a few posts in the debate starts. I thought I'd turn toward those more familiar with the details legalities of such things (the more experienced POTN community) I cannot deny they are extremely similar, but is there enough to say that there was indeed an infringement? And if there is enough to conclude that, what is the best course of action to follow?

BTW- I know at least one of them regularly uses multiple Canon DSLRs so it is also related to this board.;) I've seen several members here post different angles of this in the Transportation section of this site as well.

My apologies, I guess there was sufficient cause for the other forum's moderators to decide to pull the thread. I'll update if there is more news or better/comparable examples of the two galleries.

In the meantime, I know watermarks and webpage layouts and wording are being re-done by the original party so he can maintain originality over the other photographer.
