Problem with 40D? Light and dark images

Ok so it sounds like I'm not crazy or hit a wrong button. I guess the next question is - Is this HTP in action and working as it should or is this a bad camera? I shoot raw exclusively and have since read that HTP really isn't doing anything in raw anyways. If that's the case, and that's what's going on here, maybe I should just shut it off and call it good.

I guess I would be a little worried though that this is a symptom of something larger like intermittent cpu problems. What do you guys think? Send it back to Canon or no?

I guess my question is that even if it is HTP, why would it change between shots 1 sec apart if the light didn't change?

Also there was a discussion wrt the MkIII and HTP in another thread and the conclusion was that HTP DOES change the raw file.

I just got off the phone with Randy at Canon (who was super cool) and he looked at this post, saw the shots, and confirmed this is not working correctly. He said HTP should not cause this. Back to Canon it goes...

Hi Chris,

I've got exactly the same problem with my 40D. Was using Manual mode, no highlight tone priority, shooting at high speed 6fps and the same thing. Some shots correctly exposed and others seemed atleast 1 stop darker.

I spoke to canon today and am waiting for a call back from the technical team. You mentioned Randy who was helpful to you. Have you got his contact details? Perhaps you could send me a private message as it may be easier to deal with someone who's familiar with the problem.
