And it never ends well from this point on. Someone is always in someone elses pocket & the most money always talks the loudest. Leagues are notorious for making verbal promises to one while at the same time signing a contract with someone else that offers a big kickback.

If you all think this is bad, look into High School Senior contracts. It's a real eye opener.

The bottom line is the at the league has the right to control the commercial use of images from their game.

The (pro) photographer should never have gotten involved other than to contact the league and ask them to send a cease and desist letter. At that time the league could have said, no your contract is only for T&I and we have given permission for another photographer to sell action photos, in which case a lawsuit involving the league and the other photographer can ensue. More likely since the league is making money of the other guy, they would say OK and a cease and desist letter would be on the way.

Photographers do NOT get to use images commercially just because they take the photos
