Published Picture, but...

I never actively put my images out there. I'm into photography for the fun of it, and to share with family. However, my father showed some aircraft magazines samples of my aerial work. There is general interest, but one magazine particularly wants to use this image (external link). Here's what they sent to me in response...

Subject: RE: PPC picture

Hi... yes, the magazine really wants to use it. Send the largest highest-res
photo you have. Also, Write a small caption that you'd like included with it

I don't care about the seemingly lack of compensation. What most concerns me is the lack of a general agreement, what they have the rights to use my picture for.

I don't even have to be a career photographer to smell something a little off. I'm certainly not sending the hi-res until there is some agreement upon its usage. That sounds logical, right?

Yes! Also, do not give it away -- even if it is for one-time usage -- you should at least get the standard rate. They aren't a non-profit organization, right? I think $40-$80 is fair for one time, 1/4 page or less, in a niche publication.

Cool shot, too. I suspect not too many people fly those things (whatever it is) and even fewer have a good camera, a fish eye, and the knowledge to use it. Don't give away your expertise or time!

There are only 51 in my state, which is a very small percentage of the total aircraft. I've contacted them about a usage agreement. While it'd be nice to get it in there, I agree that I shouldn't just give away my time.

At $40-80, thats damn cheap. Take a look at the overall picture and see what its worth to you, and what it would be worth to them. You may be better served getting something aside from money if it would work out better for you. Regardless of what you end up with, send the image after you decide and everything is ironed out. Make sure you are given credit for the picture as well if you haven't been published before.
