Photographer prosecuted.. what is the world coming to?

Well I think it is understandable why the law exists and I think the judge tried to be as fair as possible with the sentence. Community service isn't going to break the guy.

Maybe the law is doesn't offer specific protection from this situation. Most laws aren't perfect, but that doesn't mean you can just bend them the fit any situation. The system wouldn't work too well if that were the case.

150 hours when the judge says he did nothing untoward. Absolute crap IMO. The judges statements don't match the sentencing.

The judge added: "What is clear is that you had no base motive, no sexual motive and there was not any question of deriving sexual gratification from what you were doing."

Judge Lawler QC added: "You always acted perfectly properly and their parents were perfectly law-abiding, sensible people who cared for their children."

Also, it wasn't the parents pressing charges it was some random dude at the photolab who said "these photos look suspect" so the cops ran in there and seized his computer.

The poor sod got 150 hours community service for that? I despair of the world sometimes...

Worse, the staff reported the pictures to the NSPCC, which is a charity... the was nothing here that could not have been solved by a little police investigation. No need for courts, prosecution, anything.

Although I agree that it is not pornography he really need to be charged with offending photography. :p The f64 group would have made a great tribunal (except for the being dead part).

Damn luck he didn't have to register as a sex offender as then the local neighbors would have found out and hounded him out of town forever.

Well, that settles the issue of me using Bonusprint for any service ever in future.

I can't believe that the judge prosecuted whilst saying that the defendant did nothing wrong. How it can be abusive to the child when it's done at the request of the legal guardian, I really can't understand.

I think that judges the world over need to realise that they can actually say "This case is f***ing stupid. Get out of my courtroom." It would save a lot of hassle for a lot of people. Except lawyers.

This is not always a valid argument...after all, many children are abused one way or another, either by a parent or their guardian. Just because a guardian says that its okay doesn't necessarily make it so. But I do agree that some of the laws on the books (here in the USA also) are a bit ridiculous and need to be revisited. I'm sure that these laws started out with the best of intentions, but like everything else in the ever-growing nanny state, the far-reaching consequences were either ignored or just plain never given any thought.
