Quick question for the big brains:

I understand that photos taken of people in public locations are legal. BUT I’m doing a project in the subways of Boston, with a permit from the MBTA. All MBTA property is private, so do I need consent from people that I take the photos of? I'm pretty sure that I don't, because of the permit, but I wanted to run it by others.

It depends on the purpose.

Art projects rarely need permissions, when the people are in a public place, even if the "property" is private (ex. stadiums). Editorial usage rarely needs releases. Advertising use always needs releases. Recently a model was awarded millions of dollars because Nestle was careless about releases.

I am not a lawyer and this has not been legal advice.

You might ask the MBTA.

Many places when you buy a ticket the ticket (or a sign where you buy the ticket) say that by using your ticket you grant the ticket seller the right to take and use photos of you on the premisis.
