It's easy to KNOW it's his photo. The matching cars are a dead giveaway. There's also a person in a red shirt walking in front of one of the cars and several of the areas of the water fall that stand out are identical. The water fall is totally random from second to second so between the cars and the details in the falls it's easy to prove.

Don't settle for anything less than a Canon 5D Mark ll and a 24-105 F4L with IS.

btw max that tineye site is BADASS!! Hopefully it will be easier for us to track our images and who steals them.....amazing software

I had a look at both images, yours and the cover and they are exactly the same (except website + cover looks to be sharpened a little extra).

Layered over each other, the clouds/water/cars are identical.
