I'd sue the hell out of her, and attach best buy under a respondeat superior theory. Failure to properly prepare employees to understand the dangers of carelessly swinging hand bags around expensive camera equipment. Twenty page complaint. Maybe you're a resident of another state and you can even bring it action in federal court...

Or maybe I'm just a law student and like trying to think of things from this point of view :)

In any case, so sorry to hear it. Hopefully you find resolution!

accidents happen. sounds like he didn't take extra care of his equipment when he was doing something else. he SHOULD have anticipated what COULD happen, and corrected it.

chalk it up to experience and foolishness.

This thread is really horrible, thinking about those "unexpected" accidents to happen to our so bloody money spend gear making me to feel worry and heart breaking always when i am using my gear. I think we don't spend on gear only, but also for insurance to be sure we are covered, to be honest, i feel sometimes i should go out and shoot landscapes with my 350D and sports with my 30D, any damages to those bodies fine, i have better pro bodies there protected, lol.

It's actually covered by something much older than that called common sense

When using your gear in public, never assume that anyone else

a) Knows what it's worth

b)cares what it's worth

c)is even expecting a very expensive camera to be sitting on a restaurant table.


No doubt someone will now try to sue me for posting this, such is the world in which we live :rolleyes:

Ok, here's another scenerio, you're taking picture of your nephew at a park, you're busy taking picture of him having fun with the swing from a distance, while you have your eye glue to the viewfinder sitting on the ground, a few 10yr old kids were running and chasing each other around you, and they accidently side swiped you and ran right into your camera, and broke your camera or lens as a result of the impact. Now...what can you do about it? can you demand the kid's parents to pay for the damage? or are you going to file the claim with your insurance and risk the insurance rate being jacked up eventually? Or are you going to jammed the broken lens straight up the kid's parents ass? LOL

In that case, you could take it to small claims court and sue the parents for not supervising their kids. Again, depends if you want to bother doing so.

Remember one important point out of all of this discussion... even if you could sue the Best Buy employee, the court would probably only award you for the cost of repairs... not cost for replacement.


Taking photos with a fancy camera does not make me a photographer.
