Unattended means that the owner was not paying attention to it and did not have it either attached to his person with a strap or was not holding onto it. If you are giving your 2 year old a bath and turn around to answer the phone and he drowns, he was left unattended even though you were right there. You've just got to pay attention to valuable things when they are in potentially dangerous situations. Paying attention includes thinking ahead about dangers.

You are much bigger than a kid so keep your gear out of their reach or secured in a hard case like a pelican if it's not being held by you. If your gear is in a hard case the kids can run up and jump on it and it'll be fine. You also assessed the risk of getting bumped in a recreational park and decided to bring equipment anyway.

Nobody here has posted a situation that is/was impossible to see coming.

To the OP, and I'm sorry if I missed the answer in one of the posts: was there a conclusion to this, i.e. did the camera owner have insurance and if so, what did the insurance company say about it?

I agree... the signs that say don't leave your child unattended in a shopping cart or high-chair don't mean, "don't walk away" they mean, if you start staring at a jar of peanut butter, your child is unattended and could fall.

if that were to happen to me, i would take the broken front elements and stab myself with them because life would be pointless after that incident.

Unattended doesn't mean what you think it does. The camera was on the table. Theres no indication that the strap was hanging off or anything.


If I walked up to you, sitting at a table with your camera on it, and pushed the camera off, was the camera unattended?

Yes, but the child's family would still be liable. Whether or not you chose to go after them.

My 24-70L hit the concrete the other day, with my 40D attached. The lens has a big dent in the front lip now.

Exactly that same accident cost me £149.01 to have put right by Canon in October 2007.

And Synovia, I've got major reservations about whether the childs family would ever be found responsible.

My MK III rolled down the side of a little cliff (about 15-20ft up) Had my Canon 16-35mm L on it to boot. I was freaking out. Eventually got down there, every thing was ok. Body got a bit scratched up, and the less hood had some big gashes in it, but the glass was A-ok. The hood saved it big time. That's not the first Canon I've had go flying down boulders and what not and come out with just cosmetic damage. I LOVE THESE THINGS!!!

Oh yea, and I got a full page shot from that day of shooting in a magazine. So It was all worth it.

Seems like a rather dickish thing to do for no reason. But if you've got an $8,000 camera out, the strap better be attached to your person in some manner, which makes it near impossible to push off of the table and into the ground. This was entirely foreseeable, and it's basic and common sense to prevent this sort of accident. If the owner didn't have the wherewithall to keep his expensive gear secured, that's his own fault.

Let's try another tack. You have a small point n' shoot in your pocket. Someone bumps into you as you walk down the sidewalk and you later discover that this has broken your camera. Who is at fault? You. You could have kept it in a camera bag, of which there are legion available for P&S cameras, but you decided that pocketing it was safe enough. Your lack of concern/carelessness is not the fault of others.

LOL...although I have to say that after reading this, I did call and get insurance on my new 50D and the rest of my gear. No sense taking chances!

And it only took a few minutes on the phone. So if anyone else hasn't done the same thing...you need to do it NOW!!!!
