I agree with above. Don't have time to read the whole thread but it is not really the ladies fault. I mean WTF. why would you leave a 1Ds on a table in a restaurant anyway. I can't believe a lot of you are suggestion he sue her or even attempt to. It was an honest accident and your friend is more to blame than her.

make sure the restaurant doesn't bear any culpability if their tables were placed to close together...ADA laws require certain spacing so if their table are to close then well, sue them too

disclaimer: while the above is true about ADA law I am just kidding...sorry to hear about the accident

If a person can afford a 1DSMk3 they can afford one of two things:

1. Insurance on it, or
2. To be 'self insured'....in other words, be willing/able to eat the loss himself.

Sorry to hear his equipment was damaged, but the way I view it personally, is that "I" am responsible for my gear.

To the above replies, I seriously doubt that I would get physically violent with someone just because they broke my camera...:rolleyes:

problems like this could have been avoided...

it's like when you got a new puppy, you won't take it out unless it got vaccinated right?

how about a new car? no insurance you can't drive it out of the dealer to take it home.

how about moving to a new apartment? you need a renters insurance before you can take the lease. (atleast here in so.cal)

I understand this is an honest mistake on your friends part, but it cost him that... sue her? I honestly don't think it even has chance given the circumstances of what happened.

People need to look at this from the other side. You are walking out of a restaurant. Next thing you know a broken camera is on the ground? Should you be out $8000? All you did was walk by a table.

On the other side all the camera owner was doing was resting his expensive camera on the table.

So really who is at fault? Difficult to prove. Nothing negligent about walking by OR setting a camera on a table. This just seems like a life sucks kinda moment.

Just send the stuff in. The repair bill we be less than replacement. Law suit would be pointless and a waste of time. How can you prove it was her fault?

if your in the restaurant that table is not for an 8K camera to sit in, but the pavement that's used for walking...

Also, if your out shooting and stop by a restaurant and go sit down and THEN pack your gear you need to rethink your priorities. When I'm done shooting packing my gear is the FIRST thing I do. Not go inside a restaurant a la 1Ds and 70-200 in hand and then get a seat and then pack my gear after first setting a 8k camera on a restaurant table where drinks and other crap can fall on it..

Some people only have 3rd party cover their car. So if someone hit's their car 'accidentally' he should cop it sweet in the chin and let the offender walk away scott free? Some of you guys are on drugs I swear..

Such is the irony of legal training. If you have a plumbing issue and a plumber comes, you listen to what he says is wrong with your plumbing. If you have a medical issue and a doctor sees you, you listen to his diagnosis. If you have an issue with your car and take it to a mechanic, you pay him to do whatever it is to fix the problem. you do know that his camera is not where it should be right? if someone hit my car and it is sitting nicely in my assigned space and within the marked area, I'd be pissed... if I parked my car let say 1/4 of it is sticking out on a driveway someone hit it? would i be pissed? is it my fault yes!
