In the circumstances it's unlikely you can sue the customer. You probably could sue the restaurant citing negligence in not providing sufficient room to visit the powder room, a rather essential service.

Dude, by Australian law, it doesn't matter. As long as it stationary and someone hits it. It's their fault! Given that, I don't care if it was sitting on the top of the Queen's head or J-Lo's rear, YOU break it, YOU BUY it.

I walk in inside a Camera shop, 5d on display. By my standards it SHOULDN'T be there. If I knock it down, I'd wager my left nut the Manager will be chasing cash off my ass.

Thank you for the story, i will take care of my cameras always, i learnt a hard lesson when i dropped my 5D+24-70 on the floor, good that there is a filter on the lens and the hood didn't damage and the camera seems good shape.
Now i always hold me camera very careful and i always putting it on the floor or if on the table then in the center of the table so i can at least pick up before it drops on the floor by any accident.

I need an insurance before i go to NY this year, seems there is so many situations where i will be in a trouble alone or my cameras.

.....maybe so in Austrailasia....but here in the US.....that wager would make you a one-testicle-wonder.....:cry::mad:
Up here on this side, the shop owner may cringe....bit it is all part of his risk of doing business.

Tareq,

Completely agree with you. It's expensive kit and the onus is on the owner to look after it. If I was the Insurance company (or the Judge in any court) I'd demand a duty of care which was lacking here.

I fell over after being shoved hard from behind by a local toerag in Venice and did serious damage to a 24-70 lens in doing so. But it is still my responsibility to keep it safe and I failed to do so. I now hold the camera body itself, or the camera is in the bag and I hold the bag. We live and learn.

Accidents will happen... especially if you leave something worth $10k unattended for a split second where gravity has a chance of getting it onto the ground fast, and doubly especially if it's uninsured.

The amount of potential things that could just randomly happen to expensive gear is why I have insurance.

The person in question could have slipped on a banana skin or clipped a kerb 2 minutes earlier walking into the place...

He hardly has any case at all and will not win. Small claims court will take him months and months. A very long waiting list.Pretty much it amounts to a lesson learned.

With all of my cameras, 5D was the most camera to get impacts or accidents, once in Scotland while i was jumping on some wet rocks near a river or a lake, i slipped on one of those rocks and i injured my hand a bit, and the 5D with my armor filter B+W on the lens all on my Gitzo small traveler 1 -series tripod also dropped on the rock or maybe the nearby grasses around the rocks, the filter scratch on the front thread mount only and never broken which surprised me, so this is happening without any expectations, but to be honest, we don't have any insurance company for our photography tools here in UAE, unless there is one or 2 which are unauthorized and not trusty so we forced to use them because no choice, so i traveled 4 times until now without any insurance and Thank GOD that goes fine, not sure for my next trips in the future.

you could not file in small claims as most have a limit well under the value in question. Sorry this happened, I wish the Photographer had insurance.

Ok, here's another scenerio, you're taking picture of your nephew at a park, you're busy taking picture of him having fun with the swing from a distance, while you have your eye glue to the viewfinder sitting on the ground, a few 10yr old kids were running and chasing each other around you, and they accidently side swiped you and ran right into your camera, and broke your camera or lens as a result of the impact. Now...what can you do about it? can you demand the kid's parents to pay for the damage? or are you going to file the claim with your insurance and risk the insurance rate being jacked up eventually? Or are you going to jammed the broken lens straight up the kid's parents ass? LOL

This story made me call my insurance company and check my coverage on my gear. It was only $1,500!

I bumped that up to cover all of my gear that I typically carry around with me. Man, had I lost my gear, been mugged, had an accident I would have been beside myself with the loss.

I hope your buddy is able to get his camera fixed up on the cheap. I feel for him.
