Not sure what the policy is, I should have filed an unpaid item dispute prior to it. I told him he can stick the refund though. at least I know he bought it for more than RRP

I purchased the IPOD from you for $187 but I could have purchased the 4th generation IPOD from Big W which comes all inclusive with headphones and USB and retails for $166. I purchased this IPOD as I believed as per the descriptive information attached to the advertisement that it included headphones and USB. As far as I can see, you have knowingly or unknowingly engaged in misleading and deceptive conduct which is illegal under the Trades Practices Act 1974. I would like you to send me the original headphone or to return my money and I will forward the IPOD back to you. Please let me know asap else I will be forced to report your actions as fraudulent and deceptive to EBAY.

BOTH my kids are studying law, one has just about finished, one is 50% through.

They advise me that the FEDERAL Trade Practice Act applies to businesses / corporations, not individuals buying and selling on EBay !!

There IS a state Fair Trading Act that POSSIBLY, MAY, cover this situation, but given that you said you advertised an Ipod, nothing more, nothing less, and you supplied an Ipod, the consensus advice to the buyer from my kids was "Good luck with that !! "

The only thing that could have swayed him is that you put the condition as new. But it is quite clear that you weren't including any headphones.

The photo of what's included looks pretty convincing !!

Great shot there... Nice to see 'Gloria' again... I saw this ship docked in Cartagena while we were visiting Colombia over Christmas. My wife informs me that this is a navy training ship... It would have been nice to see her in full sail!

That's hte problem, sellers can't leave neutral or negative feedback for buyers any more. IT's stupid. I mean, what about instances like this, where the buyer NEEDS negative feedback? Look at his feedback given to others, it's strewn with negative feedback.

Does anyone know a source for an EzyBox in Australia that doesn't want to my first born as payment. Kayell want double the street price in the UK, but I can't find any supplier in the UK will to ship to Australia
