He had been losing about $1,500/month on a rental property here in the desert. He owed about $310,000 on it, and the market value at the time was around $180,000. It's probably lower now. He called his lender and asked what he should do. The lender said he had basically 3 options: 1. Keep making the payments, although that really wasn't an option. 2. Put the house on the market, and try to find a buyer for a short sale. If, at the end of 3 months, the property wasn't sold, request permission to turn the property back to the lender using a deed in lieu of foreclosure. 3. Do nothing and wait for the foreclosure sale. One of the 'catches' was that they would not agree to a short sale if the borrower was still current on his payment; i.e. he had to stop making them to put the loan into default. Fast forward. The house has been on the market for almost 90 days without any offers. The client calls the lender and asks how to apply for the deed in lieu of foreclosure. The bank tells him that the house is now in foreclosure, and because it is, they will not do a deed in lieu. Note: the client received a letter from the bank dated April 29, telling him how they want to work with him and explore ways of helping him with his financial crisis. They had started the foreclosure on the 27th. Too many left hand and right hands not knowing what the other is doing.
