I'm using a 40D and I'd just like to get thoughts on what you would do to take a great sunset picture. I know this picture is no prize winner, I need less of a critique than advice on how to do it better. Thanks.

You have the right idea with keeping the tree in the photograph, however it doesn't look sharp. I would use a tripod anytime you are shooting low light photography. Another key aspect of a shot is timing. This seems like it was taken maybe, 5-10 minutes too late.
That being said, shoot in RAW. It gives you the power to bring out the colors, not the computer chip inside your camera that added saturation and contrast to form a finalized JPG image. I hope this helps... COLBY BROWN PHOTOGRAPHY
