Dilemma: Alamy the picture agency telephoned and e-mailed me today asking about one of my images that they would like to sell to a client for a nationwide advertising campaign. Trouble is I'd marked it as Editorial Only, i.e. no advertising as the shot was taken on Private Property.
The agency said that the buyers would be responsible for getting all the releases and would take full responsibilty for anything.
Should I sell it?
I have been asked many times when shooting on this property if I am for commercial reasons and have always said no, so to then sell an image I took under this pretence would be wrong, no?

Thoughts?

Can you agree to sell as long as the buyer obtains useage rights? You may need to enter into an agreement with them or something. Maybe it's something Alamy has handled before.

From what you have said the buyer will take care of any releases so presumably if whoever owns the property would get something for allowing the picture to be released and if they disagreed the picture would not be used and remain for editorial only. I would in this case agree. ~Are you allowed to tell us what the picture is of or even better show us??

The only issue would be if you know the people involved, then if it were me I would contact them first.

My only worry is that I was told not to shoot there for commercial reasons, and went ahead. The usual way is to get permission first before shooting, not wait until a sale. The buyer is accepting full responsibility but that doesn't stop me getting into trouble I reckon.

I think this is what I might do, rather than sell first. Although it is tempting to take the money and run.

Great to get that sort potential sale. And yes it seems that Alamy (their client) will aim to obtain authority to use it but the one stickng point is :-

1) Why do "they" ask about the reason for yuo taking the pictures in that area e.g. is it that if you admited commercail usage they a) might refuse or b) charge you a hefty fee for the privilege

2) Once "they" are contacted it may become obvious you were the tog and you would be banned in future ~ see 1) above ???

Having said that interpretation it is your call ~ if the single sale is high enough value ;) then jsut go for it?

I'm thinking of calling the owners and explaining the situation that someone saw the photo I took and then offered to buy it, and then asking if they can.
What do you think of that solution?
