As far as I can see if it was public property when you took the photo then there's no wrong. If you'd sold the photo before they bought it they'd have no comeback so I don't see how it's any different.

As long as all the exif is intact to show that it was indeed taken before they owned the property you will have no problems as far as i can tell.
The only thing is do you be polite and tell them, so they wont kick you off the next time you want to take a photo there?

Have you showed them your Blog? Since you write so positively about the area and review the local businesses, you should be seen as a positive force for RTW, not an evil money grabbing 'tog.

Show them that you have recently gained extra exposure for the area via newspaper articles etc referencing your blog.

Being taken before they bought it sure makes me feel a tad easier about it.
I'm just going to call them on Monday and ask what they think about it, just see how it goes. I'm sure going to mention the blog to try and make it into a positive thing.

Thanks all for your comments so far :)

From what I understand in law if you've taken the photo from public land/ anywhere the public can go ie. not private property for example a street then there is no copyright issues. So if the site was public at the time you took the photo then you have no issues with selling it.

Morning all, i read the situation as the same.

The rules apply when the image was taken not at the time of sale.

Else imagine all the legal trouble caused every time property changes hands (you could have permission from the former owner, but not the new one, AKA major headache.

I think that is the right thing to do - just call and talk it over. The whatever they say...sell it anyway! :p

After waking up at sparrows this morning I took the dog and the camera down the beach. It was a bit overcast but here's a couple of the resulting photos.

Nice shots but they are a little dark, you could do with bringing the levels up and adding some contrast.

Twin body question. As of next week I shall have a 40D and a 400D. This is to somewhat aid me in laziness in that I shant need to faff about changing lenses so much.

With that in mind I'm pondering which camera to be the normal home for which lens. Currently thinking to partner the 400D with the 70-200 and partnering the 40D with the shorter (more oft used) lenses in the 18-50/10-22/nifty (depending which I pick to go out with). How would you play it, or how do you play it for those with 2 bodies?

The darkness could come from the fact that they were taken at about 0630 this morning just as the sun was coming up and trying to struggle through the clouds. If I upped it much I started losing the sky.

Chris - I think the date saves you on this one, although I'm sure they would appreciate a call - would be a nice gesture on your part.

Can I ask everyone re; printing photographs of London landmarks (such as City Hall).. I'm hoping to print a few photographs for my university department for their walls. I'm not charging for the images, so could possibly classify it as a gift. Does anyone know the legal implications on what I can and cannot print for them?

*Edit* My thoughts are that if the images are not being used for editorial or commercial use, then it should be ok?

Chris, I can't really help on the legalities of selling that image but ...

Bear in mind that it's your home town and you could be well known there.

If the owners of the site, or the shops, object then you could find it difficult to take shots around the area, even for non-commercial use, in the future.

If it were anyone else, not from Royal Tunbridge Wells, then I could see no reason why not but there is the old adage "Don't sh*t on your own doorstep".

I don't have the best relationship with them, the last time they tried to throw me off the premises as they thought I was a commercial shooter a few hours later the papers, radio and television were harassing them for why they did it. We haven't spoken since. This was a couple of years ago so they might have forgotten, but I doubt it. As you can see, this adds to my dilemma.
The sale would be good for everyone as we'd all make money and the advertising would be amazing. This is what my approach on the phone to the owners is going to be.

I'm thinking of saying Flickr, but might not just mention anything at all.

I usually keep the 70-200 on my gripped 20D and swap the shorter lenses around on the 30D.
