Another Copyright question.

Here's the actual scenario I'm encountering.

I'm being hired (yeah!!) to make images/portraits of an up and coming athlete.

If the athlete is wearing a Nike (as an example) shirt and he decides to let Nike publicize that fact in a blog post, advertising etc. How do i benefit from it?

Should i benefit from it?

Do i have any rights?

Does Nike have to contact me to purchase those rights?

Help!

You bang Nike for big bucks as the copyright holder and you'd better have a release from the subject as well.

So regardless of being paid by the client to make the images, I'll still be able to double dip and have "nike" also pay me for the rights of use?

You Betcha (Unless for some reason you signed away the copyright to your client.)

You'll want to know from Nike their intended use for the image. If it's print ad worthy and will run in hundreds or thousands of places, price it accordingly and don't undervalue yourelf.

A. Make sure you get a model release from the athlete.

B. Make sure the contract with your client (athlete's agent) states that you retain the copyright and are licensing the client for certain uses that do not include use or sale by a third party for any commercial purposes.

C. Register your copyright.
