Sharp-shinned or Cooper's Hawk?

I'm having hard time to ID this hawk. Is it a Sharp-shinned or Cooper's Hawk?
I'm leaning towards Sharp-shinned Hawk.

Photo taken on the cloudy morning with 7D + 400mm f/5.6

That there would be a fine-point magic marker. Sharpie, to those who don't use markers.

And quite fine images, for a cloudy day they look pretty dang good.

I was late for work, but grabbed my camera and shot this one out my bathroom window.

I believe it is a Sharp-shinned also. Sun was barely up and the temp was single digits outside.

Very nice capture of a Sharp-shinned Hawk. The 2 are soooo hard to tell apart. Thanks for posting these shots. I am thinking about buying the 400 f/5.6. Shots like this really help make up my mind. Seems like a great lens for the money!

Folks here are right it is a sharpie.... and these two are hard to tell apart. The best way i know is to look at the tail feathers. The coopers has a more rounded tail with a thicker white strip at the end of the tail when compared to the sharpie.... in fact i think clint's picture is a coopers so you can see the difference in tail shape and the amount of white you see at the end of the tail

I always look at the legs and feet if possible, First one looks like a pencil legged Sharpie to me. I am guessing that the second one is an adult Sharpie too, but hard to tell. It's much easier when you can see the size of the bird.

Both are defo sharpies. See how all the feathers on the tail appear to be the same length?

Thanks guys for assuring me that indeed this is a Sharp-shinned Hawk.
What I found is that most websites suggest to look on the tail, size of the legs, and how close are the eyes to the beak: http://www.birds.corne​ll.edu …ding/accipiterI​Dtable.htm (external link) but it was still hard for me to distinguish between the two.

Funny part of taking these shots was that after taking couple series of 8 fps, he turned his head and gave me that look on #1 picture. Since I was shooting out of the window of my apartment, with houses very close to each other, on a quiet Sunday morning, echo was quite strong with repeating the sound of the shutter. Luckily it didn't scare him away...
