High School Basketball $$$

Hi there,

I've been doing some high school basketball photography - not often but occasionally because my younger brother is on the team. I always put the pictures I post-process up facebook sized so that the kids who are playing can use them.

I was approached by the school vice principle about using some of my images for school brochures for international students (did you know private high schools go looking for international students now? I thought it was just universities). I know they are prepared to pay me.

Questions:
1) I've never secured a model release for the players - is this required if I end up making $$$ on the pictures?

2) How much should I charge? If this was going into the school paper or something I wouldn't charge anything, but since this is brochures they're taking with them all over South America looking for students, I feel it's actual advertising, even though it's for a school.

Hope you watermark them - I do the same for one school but they are watermarked and have a notice saying FB usage is fine, nothing else.

Making $$ no, commercial usage yes. This WOULD qualify as commercial usage so the school needs to get permission to use their likeness. This is NOT editorial in any sense. If you were doing it editorially you would not need a release. It's been common practice for private schools to recruit internationally for years.

It is advertising no matter who it's for. Price is dependent on many factors, print run, size, etc. Check out FotoQuote - or just view an image on Getty that has the calculator.

You would have to check, but I would bet that the school already has a release for the students. They seems to file them in the paperwork we fill out at the beginning of the year now.

Something else you should consider is an elgibility issue. If a student athlete's photo is used in advertising it can compromise his/her elgibility in NCCA sports. My suggestion would be ask if they can only use shots of a player who is not planning on going to college and is a senior this year.
And yes you would need a signed release from the athlete, or his parents if under 18 otherwise that player, or his parents can sue the school & you for using the likeness in an advertisment.

Also to ad on remember you can't give them a "gift" while charging others for the same thing. Example was when I was shooting an NCAA game and overheard the school photographers (students) talking they said they sell to the general public but if an athlete or his family asks they just give them a print so they "don't upset them". After pounding my head into a cement wall while hearing this they had no clue it was illegal and can ruin a kids eligibility doing that.

Cliffordphotography is correct - I'm told that the school does indeed have a release signed by the student and parents to allow the school to use their likeness.

As to this entire thing - the school offered me $25 per photo for "ownership" of 4 photos. I told them I wasn't interested in selling ownership of my photos. Instead I told the school I'd let them use 3 images for this particular brochure only gratis, and any use of images beyond that would have to be talked about when they wanted it.

I'm pretty sure the graphic designer they hired asked them to attempt to buy the pictures for what amounts to no money. If they print one poster per picture they've still saved money at $25 per picture for ownership. I'm not making money off my photography, but I also don't want to give it away for nothing.

I'll probably hear back from them on tuesday.

So wait, I'm confused!

They offered to pay and you instead gave it away gratis.

You later say you don't want to give it away for nothing.

This seems to be contradicting and can't figure out why you'd just not tell them $25 for one time usage in the brochure and that's it. Them offering to pay and turning around and saying just use it free makes absolutely no sense at all.
