Just received my 1d MkIII, i have a sigma 10-22mm but thinking of either 17-40 or 24-70mm which 1 of the two is the better lens?

That's very subjective. One is not better than the other, they're two very different lenses. If you want a replacement for the Sigma 10-20, the 17-40 is the obvious choice. If you want something more general or long, the 24-70 is a great choice. If you want both, you could go for the 17-40 and an older 28-70 if that fits into your budget better?

But if the intention is to complement 10-22, then 24-70 will make sense in my opinion because together these two give a wider focal range with no overlap. 17-40 has too much overlap with 10-22.

If 10-22 will be offloaded and only one lens is going to be used, the choice between 17-40 and 24-70 will then depend on OP's usage and budget. Obviously, 17-40 is preferred for wide angle applications (22-52 on 1D3) over 24-70.

Sell the Sigma 10-20, get the Sigma 12-24, and then a 24-70 would be a good complement. You can keep the 10-20, but you can only use part of the focal range without vignetting.
