Hi guys,
Need your input.
The situation: A mother wants to give her children a photography session as a gift. Both children are over 18. Now, I understand that she is the Client who pays and signs the photography agreement with me, however her children are the models who I need to get a Model release from. Since I already have the Model Release clause in my contract included, and the contract is being signed by their mother, do I have to sign separate Model Releases with each of her children or mothers signature in the contract is enough?
My first clause of the contract states model's names and the name of the client- so I am going to have all their names listed in the contract.

Is there anything else I need to pay attention in this situation?

Thanks!

The Models, if of legal age, must sign the release. The mother cannot consent the release, as she has no legal authority to do so unless she has a written/signed power of attorney authorizing this.

For this reason and others, I don't have the model release and the photography contract as part of the same document.

A good many times, the person contracting the photography is not the subject of the photograph, and all the adult subjects are frequently not available when the contract is being signed.

Once they are 18 it is no different than if they are not related. If I am paying for a photo session of you...Does that give me the ability to sign your rights away? ...just because I'm paying? No different here. Mom can pay all she wants, but you have to get permission from the subjects that will be in the images.

I agree with RDKirk, separate your documents and this will not be a problem.

+ 1 for the quote above!

Keep them apart, one contract for the overal shoot (TFC, Print Or cash agreement) and a dedicated paper work for the model release!

Also, take a picture with them holding up a legal ID age document, drivers licence and such :D

Keep it simple, but always have attention to detail and you will be O.K
