printing from disc (rights)

When you sell a client a disc of finished images I am assuming they have the right to take the image to Walgreens or Costco to print up some 4 X 6's right?

This is assuming you have charged them for this...

It all depends.

You could easily sell a client a disc but tell them they do not have permission to print the images and that the disc is solely for archival purposes only.

Or you could include a print release or other form of permission giving the client the "right" to print the images.

But legally speaking, just because they have a disc doesn't mean they have printing rights, and places that you listed should ask for written permission from the photographer (you) before printing, or at least before actually selling the prints to the client. With out written permission they have no right to print and if a lab does print and sell the images to the client they can face some pretty steep fines if caught.

Wow, sounds like I have to draw up a release form then. My intention is to charge enough up front and let them print as they wish but retain the copyright. I am not selling them the rights, just the right to print.

As far as I am aware a release doesn't have to be that complicated either. Just something that simply states who you are or who your company is, and that you give the client permission to print the images. Date and sign it.

I also include a phone number, a description of whats on the CD (just very basic, such as xxx amount wedding photos) and it is printed on my companies overhead. In some situations I also include what they client is not allowed to do with the images.
