You are correct. Perpetual motion devices cannot be patented by law, at least not here in the U.S. The problem lies with the word "perpetual."

Anyone who claims they have invented one (and there are many such claims each year) would have to do two things that more normal inventions do not require:

They would have to physically build a working device; and

They would have to prove that that device does indeed function perpetually, i.e., functions without entropy.

Almost doesn't count. A device that has so little entropy that it would outlast the universe still has entropy, i.e., it would still stop (or at least slow down), and would not be perpetual.

"Perpetual" is one of those red-flag words that is guaranteed to earn you a rejection. Other such words are "infinite," "uncountable," "incalculable," and other such absolute terms.
