I did a search on this forum and couldn't find an answer to my specific question.

I know this is such short notice, but I didn't give much thought into the legal aspect of photography until now, when my mother in law brought it to my attention. Now I'm a little nervous about this. I can't help but think 'What the heck have I got myself into?'

Enough rambling. Here's what's happening. There's a small airshow coming up tomorrow at a local airport. One of the cool things they do is give children free aircraft rides. I'm thinking the parents of these kids might appreciate high quality pictures of their child posing with and inside the aircraft,as well as shots during the flight. What kind of release would I need to get?

Here's something simple I came up with:

I (parent/legal guardian) do hereby give permission to Kira A. (my full name) on this day, September 25, 2010 to photograph my child, (child's name).

I understand no images or likeness of my child will be published in any way without prior parental knowledge and consent.

(Parent's signature) (date)

Will something quick and simple like this work? I'm planning on keeping these forms as well as the images on file for up to a year, so parents can order more prints from me if they want, and also in case anyone wants to kick up a stink. I'm going to be selling the prints to the parents, if they want some.

I don't see myself needing to publish these pictures at all. Since I don't see myself doing much in the way of people photography. My photographic passion is in aviation. My photography isn't the bread winner but instead is a hobby I love doing, that may or may not making any money.

Thanks folks!

IMO, and I could be wrong, but I work for the local newspapers, and what my chief Photographer told me is, they are in a public place, they cannot do anything about being photographed. Now because this is a newspaper type thing it may be different, or it may not, I am sure others will chime in though :)

If you aren't throwing them on a smugmug or zenfolio for any random person to buy, you need not a waiver. Instead, I'd build a package (Prints, CD, etc) and try to sell them to parents directly at the airshow.

(Although when in doubt, cover your ass in a contract!)

Do you have permission from the air show producers to sell the photos?

You're operating a business on someone else's property--you will need permission for that. Although the airport itself may be municipal, you may be on an apron that is leased by an airline.

If you're free to be in that location by permission of whoever has custody of it, you don't need a release to photograph the people who are there, nor do you need a release to offer them the photographs. Nor, for that matter, do you need a release to place them on a website as a means of offering them the photographs.

A model release is needed for commercial use of photographs of a human being. "Commercial use" means using the photographs to further promote a service (including your own photography business) or a product.

"Commercial use" does not include selling the photographs to that person, nor does it even include selling the photographs to another individual as art, nor does it include exhibiting the photographs in an art gallery or an art website.

However, you do need to make your intentions clear to the parents just for good business relations. For instance, you can have some business cards made up that explain that the parents can go to your (secured) website and purchase pictures if they'd like.

Thanks for your responses everyone!

The airshow has come and gone. I went and had a blast. I decided not to try to sell anything until I knew more. Also, they seemed to have an "official" photographer (with a point and shoot I might add :/) selling her pictures to the parents. They wanted 10% of my earnings for the day or $10, whichever ended up being greater. Is that a reasonable fee to charge for being a vendor during a small scale event like that? The fly-in was pretty little, I'm guessing only a few hundred at most attended. I'm going to try to make some sales next year when I'm better prepared for this. Hopefully by then, I'll have better pictures and a new lens too.
