Release form...for client, not me

Hey all....read through a bunch of threads here. Wow...I need to keep reading.
Anyhow, I have a client that paid for services and is paying for prints. I am more than satisfied with the transaction. I am giving her a copy of the prints on CD, she paid for it. Issue that I want to avoid is if she or her friends want to print more from the cd, labs may not print them w/out a release. What can I give my client that would show the Print Labs/Stores that she has permission to print?

For the few times that I do give out printable files to customers I will provide them a letter in PDF format that basically attests to the fact that I am the copyright holder and that by presenting this letter to the lab they have my permission to print them. I haven't seen anything in the way of a standard wording or form. I don't think that it has to be anything fancy, simply deliver the message.


My life is like one big RAW file....way too much post processing needed.

Your Invoice for your services should include the deliverables-prints, images on CD, etc and include the license of images provided to the client. A simple line such as "The Client has permission to make prints for personal use of all images included on the CD." should be enough for most print shops.

Legally most labs a customer is likely to go to will operate on the following idea.

The only way to get high resolution digital stills (both dimensions larger than 1000 pix) is to be given them by the photographer. If your files are that large then you are good to go. Same thing as having been given negatives in the past. If the photographer provides the client the means needed to produce the image as an original then the photographer has implied in doing so that the customer has permission to do that.


With that said I put my personal use release on the disk as .pdf and .jpg and sometimes .html for additional device compatibility.

Ah, no, in the US there is no such legal implication.

Legally, in the US they can be held responsible for not having done a minimum level of "due diligence" to determine if the person asking for copies has the right to do so.

If you know of any labs operating otherwise, please let me know their names, and I'll make sure they get properly threatening letters of action from PPA's legal staff.

This is what I use.


To Whom It May Concern: The bearer of this notice (“Bearer”) has purchased high-resolution digital files from his/her Wedding Photography (“PHOTOGRAPHER”). Bearer is hereby granted permission by PHOTOGRAPHER to reproduce the images and make an unlimited number of prints, for personal use only. This permission applies worldwide. Bearer agrees that he/she may not use any PHOTOGRAPHER images for commercial or editorial purposes, or enter any PHOTOGRAPHER images into competition without the express written permission of PHOTOGRAPHER. PHOTOGRAPHER retains the copyright to all images, per USC Title 17 (US Copyright Law).

Copyright and Licensing Notice The images that are being provided to you are licensed to you for any reasonable personal purposes, including but not limited to: printing, copying, emailing, and web publishing. Your license does not include use that results in financial gain, including but not limited to: advertising, stock photography, print sale profits, or resale of any nature. Your purchase of the original files releases PHOTOGRAPHER from any liability due to loss or damage of the images, and also releases PHOTOGRAPHER from any obligation to maintain copies of any digital file, image, or photograph. You hereby grant to PHOTOGRAPHER the right to use and publish images and photographs taken at your photography session to further promote its service, including portfolio, web site, display, advertisement, and editorial use. PHOTOGRAPHER agrees to limit the use of these images and photographs to promotional use only.
PHOTOGRAPHER may revoke this license at any time and for any reason. PHOTOGRAPHER retains all copyrights to the images and derivative works thereof. By using any of these images, you are agreeing to the above terms.

Replace Photographer with your name.

ty for all the responses! If it's ok...I'd like to use steel city's and modify it slightly. On a side note, my wife and I spoke about this the other night. I have only been asked 1 time if the photos were mine or a professional. Other than that, I could have them printed....of course they were mine!
Say someone wants cheap 4 x 6 prints @ Walgreens. How are they to know the customer did not shoot the photos?

It all depends on the person working the counter. I have used Walgreens in a pinch many times and have had to verify that I had the rights to print them. I have a copyright form signed on file w/ our local Walgreens. Their policy is that if there is any doubt, then a copyright form has to be signed and proof of copyright. Now, if the kid making minimum wage really doesn't care about that, then he might print them w/out requiring a copyright form.

I've used Walmart before, too, and have found that the their quality is much better than Walgreens. I also had to a copyright form for them as well. I've given clients CDs to have pics printed and Walmart has called me at the number on the release to confirm the person was able to have them printed.

Snapfish prints and walmart.com (not the one where you go into the store and get it at the counter... only the option to deliver at home) have both printed my photos without asking about copyrights.
