I was asked to photograph a fashion show, it's at a state expo center and basically a collection of small retailers around the neighboring towns. These are mostly small start-up, privately owned businesses.

The owner has 13 models, and asked me for an hour of my time to cover the runway segment and possible a few BackStage headshots. She is interested in obtaining the edited digital files.

We agreed on a price, and I feel it's fair for both of us. As far as her use of the pictures, what should I limit it to? Her website? What if she wants to make prints and advertise? I want to be fair and would hate to loose the gig (she has a limited budget) but also want to be fair to myself. What is a typically usage agreement without getting into hefty fee's?

I would expect that advertising is the reason she wants photography. Usage should have been the first thing discussed ("Yes, I'm a photographer. What do you want my services for?"), long before you agreed on a price.

But now that you've already set a fee, you need to find out what usage the client is presuming and write that into a license agreement. If her advertising desire is relatively modest--say, print ads for the next year--I would not try to re-negotiate the rates. If her intentions are to go electronic or with billboards, I might say that is not included in my normal commercial pricing (which it isn't, and my website says so).

You also need to make sure the model releases cover her presumed commercial use as well as your own...which may impact payment to the models.

I believe she is just going to use the pictures for print cards and web marketing.

Ugh, so I have to get a release signed from each model? This content really won't help my portfolio so I have no interest to post it to my web page
