Another zoo wants to use my Bronx zoo shots??

This can be tricky..... Anyway, I was contacted by another zoo from another country in Europe. They want to use one of my Bronx zoo snow leopard shots. They will give me credits...:) Declined? Ask for some monetary compensations? BTW, it will be on their magazine... Forgot to add that they saw my shots on Flickr....

Only non-commercial photography is allowed in the Bronx Zoo without persimission from zoo administration. So it is mostly likely not legal for you to sell the pictures or even give them away if their use will be commercial.

Hmmm....I reread the message. He wanted a hi resolution of it....Hehehehe...he works for a publishing company doing a magazine for the zoo. That's so wrong on so many levels. He is going to give me credits for it. Wow.....:) I am not going to name the country.

I know the European Union is for ever expanding its net, but not so far as far as Nigeria, I think.

Um, you do realize a magazine is editorial and not commercial usage right? You realize editorially you can sell the images to whoever you want as long as the zoo rules only forbid commercial usage right? There seems to be a major lacking of understanding what is commercial and what is editorial where you have rights given to you under the first amendment in the United States.

The only issue I see is no payment, that means no usage - PERIOD!! You're not paying = you get nothing, it really is as simple as that. Credit means nothing, it won't get you in the door, won't help your career, it's about as big a myth as trickle down economics, big foot and sexy vampires.

A magazine itself, never. How the image is used in the magazine could be commercial IF they use it as an advertisement for the zoo (Bronx or otherwise). This would be a paid advertisement, not just a fluff piece pumping up the zoo and/or zoos. If it's a photo to support an article it's editorial usage and you have full right to sell the image.

A brochure, a sell sheet, a promotional pamphlet, a catalog are commercial.

Is a magazine for the zoo, or the zoo's in-house magazine. I would think their zoo would have a snow leopard. Here is the shot:

I told him I don't have the legal rights to release the photo to him. If he thinks the otherwise (I would think he would know), then, I see if I can get him to pay me....which I doubt...:)

Most zoo's have photographers, maybe they just didn't get a good shot or they just don't want to pay for one. Which of course that means they will not want to pay you. It may be someone you just ignore and move on, they're not worth the time. I turn down this type of crappy deals all the time! Often they come back offering to pay or asking for a quote - last one JUMPED at the price I offered after crying poverty with no budget. It's a tactic for some, it's true for others, but no play no images. (this would not include charities that may need help).
