It might be of interest to note that when Highlight Tone Priority is enabled the histogram shifts approximately one stop to the right. Attached is from a 5D2. The 40D shows the same shift.

And when I took the photos on which I checked the histogram, I had HTP enabled. My histogram looked exactly like this screenshot.
