I don't think that the president is any different than any other individual when it comes to marketing his image. All you have to do is get him to sigh a release contract allowing you to use his image for commercial purposes same as you would for anyone else, like me. ;)

I think you're gonna catch a lot of other shrapnel with this post...

Disrgarding the quality and questionability of the photo, itself, I think the answer to your question would depend on what use you were marketing the image for.

AFAIK, Inaugural "SWAG" is all licensed through the Presidential Inaugural Committee which I believe is a "non-denominational" organization.

Actually since POTUS Is public figure you do not need any release at all.. regardless of usage.
However if this image isn't yours.... you could get a legal smackdown from the copyright owner.

I thought that was the case also....with all of the stuff I've seen from t-shirts to memo pads displaying the presidents photo, I would find it really difficult to believe that everyone was able to get the president to sign a model release.

Of course, you can sell for editorial purposes with no worry at all since a model release is not required for editorial use.
