I don't think that the president is any different than any other individual when it comes to marketing his image. All you have to do is get him to sigh a release contract allowing you to use his image for commercial purposes same as you would for anyone else, like me.

Disrgarding the quality and questionability of the photo, itself, I think the answer to your question would depend on what use you were marketing the image for.

Actually since POTUS Is public figure you do not need any release at all.. regardless of usage.
However if this image isn't yours.... you could get a legal smackdown from the copyright owner.

I thought that was the case also....with all of the stuff I've seen from t-shirts to memo pads displaying the presidents photo, I would find it really difficult to believe that everyone was able to get the president to sign a model release.

Of course, you can sell for editorial purposes with no worry at all since a model release is not required for editorial use.
