All you have to do is get him to sigh a release contract allowing you to use his image for commercial purposes same as you would for anyone else, like me. Not sure why, but call me JJ.

However if this image isn't yours.... you could get a legal smackdown from the copyright owner. I thought that was the case also....with all of the stuff I've seen from t-shirts to memo pads displaying the presidents photo, I would find it really difficult to believe that everyone was able to get the president to sign a model release.
