Got this in my Flickr inbox the other day. Sounds kind of fishy. I'm not too excited about "Being Published" (They say that like it's a big deal) but should I be looking into any compensation with something like this? The images are some product shots (external link) of my Crumpler 5MDH that I did a while ago. The message is below:

Dear Sir/Madam,

I am an editor at CityZapper.nl, a Dutch publishing company. We are in the process of publishing information about travel essentials in our special issue of a magazine (we normally don't publish a magazine) that we give to our customers for free on a holiday fair. We would like to publish an item about the crumpler bags.

For this, we need a nice picture of the crumpler bag.
We could not get in touch with the maker of the product for a picture. We went to look on Flickr for a nice picture of the bagsr.

I think your pictures are very nice, but all the rights are reserved. I was wondering if you are ok with us using the pictures? It will be used in a free magazine, and your name will be shown underneath the picture, with whatever text you like.

The picture I would like to use is any of the pictures you have from the crumpler bags, I might not use them all, but I would like the option.

If you are ok with it, can you please send me the high resolution
picture? Or send me links on which I can find them?

Let me know if you are ok with us publishing your picture!

Kind regards,

... and they aren't getting any funding from advertisers? ;)

Unless you see a direct revenue stream from this deal I'd insist on a fee.

Strange a manufacturer wouldn't supply pictures for some free advertisement in the form of an article. Sounds fishy to me, if it were me I would send them a rights contract and a fee schedule and probably not hear from them again.

Yeah, it sounds fishy to me too. Like, why would Crumpler not supply images for them if it's an article about the bags? Not only that, the images I have are of the old model, not the new model.
I wrote them back and thanked them for checking with me first before using the photos, but that I'm still thinking about it.
And TJ, I was thinking the same thing. Even "Free" magazines have income, they have to, otherwise how would they pay staff?

Of course you should be compensated. If they don't want to compensate you, tell them to pound sand.

For an idea of pricing, head over to Corbis or Gettyiamges.com, load up a Rights Managed image, and use the pricing calculator. Those rates are often fairly close to industry standard.

No pay, no use, period, end of argument, end of thoughts, end of anything. You want to pay for it then fine we can talk, but a darn photo credit means zero, nothing, zilch, nadda, zip! Doesn't matter if it's in the Netherlands or the local rag, it's meaningless!! The only photo credit that matters is the one on the check. Charity is one thing, give it away to help others in need (volunteer to shoot for an animal shelter, or anywhere really like that). This is not one of those cases.

First, I don't believe they can't contact the manufacturer.

They are just trolling for freebies on Flickr (along with many others). Too cheap to pay for usages and offering a "photo credit". This is becoming way too common, so I guess there are people falling for it and giving use of their images.

Screw em.

Send them a quote for usage licensing (if you have enough info to put something together). I bet you'll never hear from them again.

being credited for the photo will do absolutely nothing. when was the last time you saw a photographer's name in the credits for a photo, researched their work online and bought something from them? never.

tell him that you'll give him the images for a price, but don't give in to the "free with credit given" BS.

Thanks guys. I did write back asking what the usage would be for exactly and what the circulation of the magazine would be. The photos have been up for so long, I think it might be a little late to watermark them. Maybe I'll run some through tineye.

I hate it when people post a link without any kind of explanation as to what I'm going to be looking at. :|

Having said that it is a very good clip :D
